Health & Safety Liability
Accidents do happen and if you’re prosecuted for a breach of health & safety legislation the legal costs alone could easily run to thousands of dollars.
Not to mention the cost of reparations a judge may award to an injured person. There is no specific policy for health & safety liability and the law says you can’t insure for health & safety fines.
LEGAL DEFENCE COSTS & REPARATIONS – STATUTORY LIABILITY INSURANCE
The business, as well as directors, officers & employees acting on its behalf, can be covered by statutory liability insurance if prosecuted for breaching health & safety legislation, but only for legal defence costs and reparations awarded upon conviction.
PERSONAL LIABILITY OF DIRECTORS & OFFICERS – MANAGEMENT LIABILITY
If a director or officer of the company is held personally liable for a health & safety breach they can be covered by management liability (directors & officers liability) insurance. Again, only legal defence costs and reparations can be insured.
