The business, as well as directors, officers & employees acting on its behalf, can be covered by statutory liability insurance. Only defence costs and reparations (awarded to the injured person or their family) can be insured, the WorkSafe fine can’t be insured by law.
PERSONAL LIABILITY OF DIRECTORS & MANAGERS – DIRECTORS & OFFICERS LIABILITY
If a director or officer of the company is held personally liable for a health & safety breach they can be covered by directors & officers liability insurance. Again, only legal defence costs and reparations can be insured.
